Records concerning lobbying investigations by the Ethics Board and its predecessor agency, the Secretary of State, that are open for research either because they consist of case files that predate the creation of the Ethics Board in 1990 or because they include audits, on-site reviews and other types of records now considered confidential. In 1990 when the Ethics Board assumed oversight responsibility for lobby law enforcement, it was determined that the investigation case files created by the Secretary of State were open. However, no records of this type have been transferred to the Archives.

- RESTRICTED: All case files received before 2010 are open. All other case files remain confidential (Sec. 19.55(2)(b), Wis. Stats.) unless made public in the course of a hearing to determine if a violation occurred or in the course of any prosecution initiated. Records transferred to the Ethics Board from the Secretary of State's officer per 1989 Wis. Act 338 are all open to the public. These investigations were all closed before 7-1-90. Any new investigation initiated by the Ethics Board will be closed to the public unless the exceptions stated above are met.
