SEC. 28. HOTEL MENU AS EVIDENCE. 
Naming of game and fish upon bill of fare is prima 
facie evidence of possession. (See Secs. 27, 9, and 38).

SEC. 30. FISH - IRRIGATION DITCHES. 
"It shall be the duty of the owner or owners of any 
canal or ditch into which any portion of the waters of 
any stream containing game food fish as defined by this 
chapter are diverted for the purpose of irrigation or 
any other purposes which  consumes such waters or any 
user of such waters so diverted, to construct and main- 
tain at the head of such canal or ditch a paddle wheel 
or wheels, or other device. as may be directed by the 
State Warden, which shall be maintained during such por- 
tion of each year as such waters are diverted for ir- 
rigation or other purposes." 
SEC. 31. DESTRUCTION OF ILLEGAL DEVICES. 
Illegal devices (See Sec. 19) are declared a nui- 
sance and may be destroyed by any person. It is the 
duty of every warden to destroy them, and he is not sub- 
ject to prosecution for so doing, but he may not seize 
or destroy firearms. The State Game Warden may use any 
device to capture for propagation purposes. 
SEC. 32.   PROSECUTION, COSTS, FEES, POSSE EXPENSES. 
"When an arrest for a violation of the game law is 
made by a deputy warden* not under salary, and the de- 
fendant is convicted, there shall be taxed as costs in 
addition to court fees in favor of such warden the same 
fees as a constable is entitled to in a case of misde- 
meanor, and if collected from the defendant, shall be 
paid over to such deputy warden and shall be his person- 
al perquisite for which he need not account, but no 
such fee shall be allowed in case of acquittal nor shall 
the county or State be liable for such fee in any event.
